THE WILL OF THOMAS BADNELL OF ST. JOHN STREET, SURREY

  11 AUGUST 1813

In the Name of God Amen. I Thomas Badnell of Saint John Street, Surrey Road in the County of Surrey, Gentleman, being of sound and disposing mind, memory and understanding for which I am thankful to Almighty God, considering the certainty of death and the uncertainty of the time thereof so write publish & declare this my last will and testament in manner following that is to say first I commit my soul into the hands of  a  ……. God hoping for mercy thro’ Our Lord Jesus Christ unto eternal life and my body I direct to be buried in the vault belonging to me in the church yard of the parish of Christchurch, Newgate Street, London in such manner as my executors hereinafter named shall in their discretion feel decent and proper.

 

 Item I direct all my debts funeral expenses and the expences of proving this my will to be fully paid and satisfied as soon as conveniently may be after my decease.

 

 Item I give and bequeath unto my friends The Reverend Jonathon Carr of Denmark Row in the parish of Camberwell in the County of Surrey clerk and Thomas Arnott of Acre Lane in the Parish of St. Mary Lambeth in the same County Timber Merchant my executors hereinafter named the sum of Two Guineas each as a mark of my esteem and as a recompense for the trouble they may have in in the execution of this my will and the trusts hereby in them recorded.

 

And as to all the rest residue and remainder of my estate and effects whatsoever the same being wholly personal, I give and bequeath the same unto my said executors and the survivor of them upon trust to lay out and invest the same in their or his own names in real or Government Securities to pay the interest dividends or produce thereof to my daughter Rebecca Arding wife of George Warren Arding or to permit my said daughter to receive the same during the term of her natural life to and for her own and separate use and benefit independent of her present or any after taken husband and not to be subject to his debts control and engagements and I declare that the receipt and receipts of my said daughter shall notwithstanding her coverture be from time to time a good and sufficient discharge to my said executors for the same and from and after the decease  of my said daughter Rebecca Arding I give and bequeath all the said rest and residue of my estate and effects or the funds or securities which the same shall be so laid out or invested into  unto the children of my said daughter Rebecca Arding living at the time of her decease to be divided if more than one equally between them share and share alike  and if but one to such only child to be paid  when and as  they he or she respectively attain the age of twenty one years and I do direct my executors either survivor of them to pay and apply the interest or dividend of the part or share of such of the children of my said daughter Rebecca as shall be in his or her minority to and for his or her maintenance and education until he or she attain the age of twenty one years and I do hereby nominate constitute and appoint the said Jonathon Carr and Thomas Arnott executors of this my last will and testament and hereby revoking all former and other wills by me at any time heretofore made do publish and declare this only to be my last will and testament.

 

 In witness whereof I have hereunto set my hand and seal this eleventh day of August in the year of Our Lord one thousand eight hundred and thirteen. Thomas Badnell   signed sealed and published and declared by the said Thomas Badnell the testator as and for his last will and testament in the presence of us who have hereunto subscribed our names as witnesses to the said actions     ….. the word ten in the  20 line from the top of the first sheet having been written upon an erasure  and the word warren interlined between the 28 & 29 lines of the same sheet. Proved at London 2 March 1816 before the Worshipful …….. parson Doctor of Laws & surrogate by the oath of the revd. Jonathon Carr, clerk and Thomas Arnott the executors to whom administration was granted being sworn to administer.
